No Changes in WC Claim Forms, Pamphlets and Posting Notices for 2019
The Institute has received calls from claims administrators noting that some organizations that market workers’ compensation notice materials along with other mandatory employer notices have begun advising them to preorder 2019 versions of the various required pamphlets.
Please be advised that the DWC-1 claim form/NOPE, the requirements for the workers’ compensation new hire pamphlet, and DWC’s version of the posting notice are imbedded in regulation and no changes have been made to those regulations since they were adopted in July 2015 with a January 2016 effective date. Furthermore, none of the statutory changes enacted this year will require revisions to the workers’ compensation posting notices (CCR §§9881 – 9881.1), new hire pamphlets (CCR §9880), or claim form/Notice of Potential Eligibility (CCR §10139), so you may continue to use current versions in 2019.
CCR §9883 allows insurers, employers or private enterprises to develop their own workers’ compensation posting notice and new hire pamphlet, and CWCI updated and obtained DWC approvals for its new hire pamphlets and posting notices in late 2015 to make them compliant with the benefit notice regulation changes that were adopted at that point.
