No Changes in Required WC Pamphlets, Posting Notices & Claim Forms for 2022
The Institute has received several inquiries from claims administrators asking if the state will require any changes to the new hire pamphlets, posting notices, or DWC-1 claim form/NOPE for next year.
There were no legislative or regulatory changes this year that will require any changes to these notice materials, so claims organizations may continue to use the current versions in 2022.
CCR §9883 allows insurers, employers or private enterprises to develop their own workers’ compensation posting notice and new hire pamphlet, but they must be approved by the DWC. CWCI’s versions have been approved, and we will continue to stock the new hire pamphlets and posting notices in English and Spanish [per LC §3551(b) and CCR §9883(a)(1)(2)], the 6-part DWC claim form/NOPE, and our injured worker pamphlet, Facts for Injured Workers, which is not mandatory, but which many claims organizations provide to injured workers to help explain their rights and obligations and the workers’ compensation claim process. CWCI’s injured worker pamphlet also includes language that can be used to meet the Ins. Code §1871.8 notice requirement on fraudulent receipt of TD and the LC §3553 notice requirement for victims of workplace crime.
These materials are currently available in our Forms/Publications Store, and we will continue to reprint them as needed. However, given the supply chain and delivery issues that have arisen recently, we highly recommend that you check your current inventories and assess your needs for 2022 to make sure that you are adequately stocked, especially if you plan to put together claim kits for January renewals.
