DWC Issues Newsline on Pharmacy Attempts to Directly Charge Injured Workers
For your reference, DWC issued the enclosed Newsline this afternoon after receiving reports of pharmacies that have been (or are considering) charging injured workers for prescriptions covered under workers’ compensation.
In his letter to the CEO of the California Pharmacists’ Association, DWC Administrative Director advises that pharmacies that accept direct payment from injured workers’ risk violation of Labor Code Section 3751 subdivision (b) and can be held liable for three times the amount illegally collected, plus attorney fees and costs.
