CWCI Begins Shipping Revised DWC-1 Claim Form/Notice of Potential Eligibility
The Institute has taken delivery on the revised, 5-part DWC-1 Claim Form/Notice of Potential Eligibility (CCR §§ 10117.1 – 10118.1), which incorporates changes from SB 899 and earlier reforms. The state approved the form last month, and this week CWCI began fulfilling orders to those who placed orders after receiving our August 2 Executive Memo.
As noted in the earlier memo, the effective date to begin using the new form was August 1. DWC posted a copy of the new DWC-1 at www.dir.ca.gov/dwc/DWCForm1.pdf and advised that copies could be downloaded so employers and claims administrators could comply with the August 1 effective date. However, the DWC-1/NOPE was designed as a 5-part form, with the new Notice of Potential Eligibility as a cover sheet, followed by four copies of the claim form, so this method would mean downloading, photocopying or printing, and assembling the form. Because recently proposed audit regulations [CCR §10111.2 (b)(25)] would impose a new $100 penalty for each failure to provide the correct claim form, CWCI requested a grace period to provide adequate time for the 5-part form to be produced and distributed. Following that request, the state agreed that the DWC Audit Unit will not start assessing penalties for failure to provide injured workers the new claim form until October 1, 2004.
Demand for the new form, as well as our recently revised employee information pamphlets and posting notices, has been extremely high. CWCI will continue to process and ship orders for the new DWC-1 in the order received. If you have already placed an order, you can expect to receive shipment within the next three weeks. If you have not yet ordered the new forms and you wish to meet the October 1 deadline, the Institute strongly advises that you order as soon as possible.
CWCI will continue to stock the claim form, along with the pamphlets and posting notices. The claim forms are shrink wrapped in sets of 100, which is the minimum order, and significant savings are available on bulk orders.
